Terms of Service
1. Who we are and what this covers
Hourino is a time tracking service operated by [[TODO: legal entity name]], registered at [[TODO: registered address]], company ID [[TODO: company ID / IČO]] ("we", "us"). These terms govern your use of the web app at app.hourino.com, the Hourino desktop app, and this website.
By creating an account you agree to these terms. If you do not, do not use Hourino.
2. Your account
- You need a valid e-mail address and you must keep it working — it is how we reach you about your account and how you recover access.
- An account belongs to one person. Sharing credentials makes reports meaningless and is not allowed; invite people to your workspace instead.
- You are responsible for what happens under your account. Turn on two-factor authentication if the data in your workspace matters to you.
- You must be at least 16 years old.
If you invite people into a workspace you administer, you are responsible for who you invite and for what they can see there.
3. Plans and payment
Current plans and prices are on the pricing page. Payments are handled by our merchant of record, [[TODO: confirm Creem]], who issues the invoice and handles VAT. We never see or store your card details.
- Paid plans renew automatically for the same period until you cancel. Cancel any time in the app; the plan keeps running to the end of the period you have paid for.
- Prices are [[TODO: excluding / including]] VAT. VAT is added according to the rules for your country.
- We may change prices, but not for a period you have already paid for. We will give at least [[TODO: confirm 30]] days' notice by e-mail before a change affects your renewal.
- If a payment fails we will retry and tell you. If it keeps failing, the workspace drops to the free plan — your data is not deleted, but paid features stop.
- [[TODO: refund policy — e.g. 14-day withdrawal for consumers under EU law]]
4. Acceptable use
Do not:
- break the law with it, or use it to help someone else break the law,
- try to break into other people's workspaces, probe our infrastructure, or work around rate limits and plan limits,
- upload malware, or use Hourino to send unsolicited e-mail (invitations are for people who expect them),
- resell Hourino or offer it as your own service without a written agreement with us,
- put a load on the service that degrades it for everyone else.
Security research is welcome. If you find a vulnerability, tell us at [[TODO: security contact e-mail]] before telling anyone else, and do not access other people's data while looking.
5. Your data stays yours
Everything you track in Hourino — entries, clients, projects, reports — is yours. We do not claim ownership of it and we do not use it to train anything.
You give us only the permission we need to run the service for you: to store your content, process it to produce your reports and exports, back it up, and show it to the people you have invited to your workspace. Nothing more.
You can export your data from the app at any time, including while your account is being closed. How we handle personal data is in the privacy policy.
6. Availability
We work to keep Hourino up, but we do not promise uninterrupted service. Maintenance, upgrades and failures happen. We will announce planned downtime in advance where we can.
The free plan comes with no availability commitment. [[TODO: state an SLA for paid plans, or say explicitly that there is none]]
We may change features. If we remove something you rely on, we will give notice and, where it matters, a way to get your data out in a usable form.
7. Ending it
- You can close your account any time from settings. Export first — deletion is permanent after the grace period described in the privacy policy.
- We may suspend or close an account that breaks section 4, does not pay, or puts the service or other customers at risk. Except where the law or an immediate risk says otherwise, we will warn you first and give you a chance to fix it, and always a chance to export your data.
8. Warranties and liability
Hourino is provided "as is". We do not warrant that it will be error-free or fit for a particular purpose. In plain terms: check figures before you invoice a client from them.
To the extent the law allows, our total liability for any claim arising from these terms is limited to what you paid us in the [[TODO: confirm 12]] months before the claim. We are not liable for lost profit, lost business or indirect damage.
Nothing here limits liability that cannot be limited by law — including for intentional harm or gross negligence, and including consumers' statutory rights, which these terms do not affect.
9. Changes to these terms
We may update these terms. For material changes we will tell you by e-mail or in the app at least [[TODO: confirm 30]] days before they take effect. If you do not agree, close your account before that date; continuing to use Hourino after it means you accept the new version.
10. Governing law
These terms are governed by the law of [[TODO: confirm Czech Republic]], and disputes belong to the courts of [[TODO: confirm court / seat]]. If you are a consumer, this does not deprive you of the protection of the law of your country of residence, and you may also use out-of-court dispute resolution [[TODO: name the competent body, e.g. ČOI for Czech consumers]].
